Leasing a plot of land, help please

Hello,

Hope someone can help me please.

I am about to lease just under 4 acres of grazing for my horse, it is on a private road.

The landlords have put a clause in the lease stating the tenant must insure the property for 3rd Party/Public Liability.

I have tried so many companies including specialist brokers and all have said there is no such policy and that they (the owners) must insure for this as it is legally their liability.

Can a legal person give me their opinion please as I am struggling to convince the owners and really do no know how to get around this issue.

My horse is insured for public liability so should she be involved I would be covered.

Thanks for any help/advice/opinions you can give.

Hi LisaD1, I think your answer is in the fact that you have contacted brokers/insurers and they have told you the insurance the landlords are demanding you take out doesn't exist. Why are the landlords asking you to obtain the cover? Do the terms of the lease make you responsible for upkeep of the land? If so it seems reasonable that you take out the 3rd party liability insurance, but having said that brokers are the experts on cover availability so I would go back to the landlords and ask that the relevant clause be taken out of the lease/amended if you are sure you can't obtain the insurance anywhere (and are also sure you have been asking about the right type of cover).
