Wills and unborn children

I'm currently pregnant. Is it possible to write a will that takes account of an unborn child or should I wait until after the baby is born? Do I have to make a new will every time I have a child or is there some way of taking future siblings into account also?

You need Mumblechum MN's resident wills expert. From memory (studied probate MANY years ago) I think you can refer to children as 'issue' so if you want to leave your entire estate to them instead of naming you simply say divide between your issue. Think that is right but if not, am sure Mumbles will be along soon and put me right

Our will was written when I was 8 months pregnant and takes account of my ds and any future children - as MOS says, they just aren't named. I wanted to get it done before the birth incase anything went wrong. Made me feel better that everything was sorted.

Agree with MOS. Not a good idea if you're a man who has spread his seed widely though!

BTW my will leaves to DW then "my issue".

I usually advise clients to consider allowing for future children, and use the wording "such of my children as shall survive me and attain the age of 18/21 years and if more than one then in equal shares".

That ensures you cover all your children, and it also includes any children who you are pregnant with, but haven't yet born born.

Hi OP . I normally advise clients who have young children and/or are expecting children to simply say that their estate will be divided between their surviving children, ie not naming the children specifically.
