Hello, My next door neighbour has asked me on her behalf (no internet) to ask about her dilemma, which is as follows, to cut a long story short, she has 1 of 2 kids that believes is a different father to the other 1 (no affairs of that sort)which is now her ex, she wishes to know if after a DNA test proves he is not the father can she remove the child from the supposed father to live with her as he has custody of both, any advice will be gratefully received.

Hi,
I would think she needs to speak to a solicitor, or citizens advice bureau. It totally depends on many factors like why they have deemed him fit to have the children and not her?? They must be under some kind of court order and she must have been to a family court hearing of some sort for him to have been granted custody i'm guessing? As there are so many unanswered questions it is really hard to answer......
sorry i can't help further but she really needs to get some legal advice
good luck

I wouldn't have thought so as any court would have to take into account the best interests of the child & as posted on here it would seem being with the only dad he has known & his sibling is the status quo. Has she thought about the harm she will be doing if she insists on a DNA test? Also, if the father is named as such on the birth certificate?
