My ex is currently taking me to court to try to get joint custody of our child. My ds has already spoken to Cafcass and stated that he does not want any more mid week contact. The cafcass officer informed me of this and also that he thought joint custody would not work in our case because our relationship is extremely volatile.
My x has been trying to "reastablish" week day contact which he says was stopped when I learnt of court case (lies)
A hearing was set to decide if he should have this weekday contact and then the last judge decided against it as he believed nothing should be done until the cafcass report has been filed (6th March) something that I have said all along!
My legal aid has been temporary suspended because through a miscommunication between legal aid and the job centre. I have sent off all the relevant documents to satisfy LA so I just have to wait.
However this morning I have just found out that a week ago he applied for an appeal and wee are due in court on the 5th March (day before CAFCASS report is filed)
He is desperate to get this mid week contact to strengthen his case despite his son not wanting it...The cafcass is in my favour it seems but I now have to go to court unrepresented it seems.
Im worried that in the appeal without the cafcass findings he may get what he wants.
My lawyer cannot give me any advice and I have no money to pay her.
Should I contact my CAFCASS officer to ask him to submit the report early as I know he is already writing it?
Any advice appreciated!

You can try ringing, see what they say. How old is your ds? Why is he happy with other contact and not midweek anymore? I would worry your ex will pile the pressure on your ds about it and give him a hard time too

I think you should chase the CAFCASS officer for the report to be available for the 5 March hearing.

Prepare a note of the reasons your son has given you for not wanting the midweek contact. Is he at school? Perhaps you can give examples of where the disruption has caused problems for him.

Take copies along with you.

Why is the fool appealing? Is he unrepresented, or does he have money to burn? If he waits a few days he'll have the report in. The order he's appealing against sounds sensible to me.

Turn up and tell the judge that if they're not minded to dismiss the appeal you want it adjourning so that you can be represented.
