Hi
My husband has a judgement from an employment tribunal in his favour.
However his employers still aren't paying.
Can anybody please help??
What can he do or what does be need to do in order to get money out of these f**kers
Thanks

What is the date fo the judgement?

They have 42 days to pay, if they have not paid up in that timeframe then he may have to enforce it, to enforce it he would have to go to a county court (I am afraid that it is a separate claim- he is asking for payment of a debt - the amount that the ET awarded him). However they should have no defence and he should get his costs back (little benefit I know)

They may also be looking to appeal, and if that is the case the court are unlikely to enforce it. If it is not 42 days yet i suspect they will pay on the last day

Thanks, ya the judgement was only at the start of the week, but this has being dragging on for ages.
If they appeal do they only have the 42 days to appeal? is there a time estimate for how long this takes?

Cheers

Ok if the judgement was only at the beginning of the week, I would suggest he writes to them and asks for the money. If its a large company I would expect that will lead them to pay, if smaller they may delay it.

they can only appeal on a point of law and they are hard to come up with, so don't worry about that unless there is something obvious the ET have got wrong about the law (it doesn't matter that the employer don't agree with the findings only if they can show the ET misapplied the law).
