My DH's company is changing the rules 15 months after they took over; he wants to know if there is a time limit after which they are allowed to do this?

There is no time limit on TUPE protection. However, your DH's employer is entitled to make changes at any time provided they have a valid economical, technical or organisational reason and the transfer is not the main reason for the change.

What is the nature of this change of rules?

The original contract meant that the company paid for private health insurance for all employees. When the new company took over, the deal was that the company was still paying 100% of the health insurance premiums. Now they have informed the employees that they will no longer pay the full premiums; the employees have to pay a high percentage of the premium. DH's copy of his original contract is at work and he won't be able to get it until tomorrow; we need to check it to see if the health insurance is mentioned. We were just wondering if this would now be considered as a reasonable change to the employment, or if it would still be covered under TUPE.

It's as bridge said - there's no time limit, but all employers need to revisit terms and conditions from time to time. Your DH ought to be consulted about this and they should explain the reasons why they are proposing this change.

I know it's obvious but you also need to check that it is a contractual entitlement.

OK, DH will check his contract tomorrow to see if the health insurance is mentioned there.
