I sold my flat just over 18 months ago. I used solicitors buyer self represented. Seemingly he hasnt changed the title over to his name so although the mortgage has been dishcarged the title apparently is still in my name, so for the last 18 months the management company as been asking where there money is from me, I tell them I have sold it and give them the details of the soicitors I used they tell me there is nothing they can do I must phone the solicitor and ask them to sort it, I duly phone soicitor, they get in touch with the buyer. And so it goes round in circles.

What else can I do as this is getting tiring, irritating and I am worried how it may effect my credit rating which is already shot thanks to some scumbag deciding to hack my details from another company and using my creit card to go on a £10k spending spree.

Well I suppose technically, you still own the property - so the Management Committee has to write to you. Presumably this was a cash buyer, as if he had a mortgage the Title would have had to be changed.

Instruct your solicitor to write (1) to the Land Registry to confirm the date of the sale of your property to the buyer, and ask them to update the Title and (2) to the Management Committee to confirm the date you sold the property, inform them of the new owners name (and address, if he not living in the property) and send them a copy of the letter to the Land Registry.

Alternatively, as you still own the property, you could get an eviction order and sell the place again, making a tidy profit .

Olgaga is right. I've never come across this personally, and not sure whether the LR could change title without the TR1, which presumably the buyer is still holding, so I guess they may have to back up the application to change the register with a statement of the background and perhaps a certified copy of the TR1 if they have one on file.

Either way, you need to go back to your conveyancers to get it sorted.

Thank you for this, I think I may ask solicitor to tell buyer that I am going to stick it back on the market and see what he says as i think that may be th eonly way he will do anything.

You can't stick it on the market, as you are not the beneficial owner of the property. Presumably the freeholder gave consent to the transfer. Check what the lease says about who is responsible for the service charge. You probably aren't the tenant any more. Just send them a copy of the transfer, and hopefully they'll stop bothering you.

Collaborate, it was a joke, we have done all that the bloke who bought it for some apparent reason is not changing the name on the title deed, the management company are not ineterested in getting in touch with him only me. the owner of the property is responsible for the service charge.

But the point I make is that you are no longer the owner. Send them your copy of the transfer deed as proof. There is a difference between the registered proprietor and the owner. They are not always one and the same.
