ANYONE CLAIMED AGAINST THEIR CHILDMINDER'S INSURANCE???

My 17 month dau broke her arm in her childminder's care. She fell off the couch. Do I have a case for personal injury? Has anyone submitted a claim like this? Is it worth pursuing?

Wasn't it just an accident?

Was the childminder at fault? If not, then why on earth would you want to sue?

You'd have to prove the childminder was negligent e.g. left your child unattended on the couch knowing that she could fall off. But I'd imagine most 17 month olds could negotiate their way on and off a couch....

I think in the absence of any witness evidence as to what exactly happened, you'll struggle to prove that the childminder acting differently would have avoided the accident?

Not all accidents are someone's fault, you know?
