Can i ask , how long do Landlords have to decide how much they want to try and with hold

I admitted scratches on door was down to my Wheelchair damage

Also that i could not clean my carperts prio to leaving as the boiler was of so no hotwater or heating

So as my tennacy states i am resposible for them being cleaned I am willing to forfeit the £250 taht it states be deducted .

The introduction agency that checked me in also checked me out the property and was satisfied .

But now the LL is disputing it and teh agency is still waiting for him to reply is there a point when i can say enough and force the issues

i think he has to tell you within 10 business days (i.e. 2 weeks) of the tenancy ending. Check with the tds as it will tell you exactly how long.

Don't agree to anything at this point, wait until you have everything in writing and then start negotiating

if the landlord knew you were in a wheelchair at the start of tenancy then the scratches may be fair wear and tear,

IIRC, the carpets are wear and tear so he can't deduct from your deposit for this. He'll get it knocked off his tax anyway. Have you tried contacting Shelter? Their helpline is very good.

I'm a LL and I use the deposit protection service. By law you have to put the deposit into one of these schemes. I have just retained a deposit, and every step of the way the tenant was sent a letter to inform her of the process and timescale. She is given the right to contest the request and a mediation type service if it is disputed.

Also when the deposit was put into the scheme the tenant was sent a letter giving her the details and reference numbers so that she can check it etc.

Did you get any notification of this? If so dig it out and contact the company - they are impartial.
If not your LL has to give it all back as far as I know - speak to CAB or a solicitor but they have messed up if they havn't put the money in a scheme.

Dirty carpets are covered under wear and tear in an AST unless they are extremely stained or damaged.

Not sure about scratches to walls but I think that would be too.

I contacted the agent that did the inroduction in and checked me out as they also registered to hold my deposit

Politley but firmly pointed out tha when i checled out with them it was ok there own paperwork showed this and that i can not be resposibale for what it was 9 days after i ahnded keys back and he asled them to come back out

Carpet cleaning in end as my tennacy says i had to do it i gave in but also emailed them photos and email i sent them on moving in da showing infact carpets heavily stained and soiled

Also forwarded every email i sent LL about things needed repairing as he claimed i had not informed him

so lesson was that luckily i had kept all my emails and in end agreed to £250 carpet cleaning and £100 for scratches to the 2 doors.Think if i did not have so much emails/photos i would ahve found it lot harder

Could have argued but i needed rest back asap to put flooring down in here

Well as long as you are ok with the out come and can get settled in your new home Smile.

Always keep all correspondance, and if your agent or LL rings you about anything ask them to send it out in writing as well then you have a proper record.
