Rent paid to wrong person - what can we do?

We own a BTL that has a DSS tenant. The housing benefit was paid for the first two months of his tenancy to another LL by mistake. This LL is a small company with only a registered office (no phone number or anything we can find), we have written requesting the money is returned as has the housing benefit office and the letters were returned, addressee unknown. The HB office initially said it would recall the money but has not done so and is more or less wiping its hands of the matter - is there anything we can do? Could this be a police matter as the company is unlawfully holding money that it is not entitled to? It is a relatively new company and it is very unlikely that it has been wound up in the few months that it has been active.

Where the money is gone is not your concern, they have made a mistake, and need to cover your tenants rent. If they wont, and your tenant is in arrears, I would evict, and let the dss know that this is what you are doing. THEY owe you rent, not the other company.

you need to claim against the tenant/housing benefit office
they owe you the money

Thank you for your post. The tenant is very nice and has disabilities - we would feel very uncomfortable evicting him for something that was completely out of his control (all benefit is paid to us direct by the LA, it is not a question of his withholding it). Is there anything else we can do?
