Im in court with my ex husband and I need some advice!! I am going to produce the judge with some evidence. do i need to present this evidence to him and the judge before I go in? if so how! Help and Thanks

Yes you will need to give or present the evidence you plan to use to your exh before the Court date, you cannot just spring evidence forward in a Court without the other party having access to it.

In my case i tried this and was told i cannot do it. Likewise it was omitted from the case.

Send the evidence to the judge and his solicitor recorded delivery and keep a copy of the recorded delivery reference number.

I agree, the Court will not allow you to ambush your Ex with evidence.

What stage are you at right now? If the first hearing is just coming up now, there's no point in sending any evidence in. You will both be ordered to file full statements, and you can annexe whatever evidence you think is relevant to that statement (eg photos, school reports, etc).

The court will give you both a deadline to file your statements, and you need to send the original to the court and a copy to your ex. If cafcass are involved you'll also need to send them a copy, and of course you should keep a copy for your records.
