CSA - XH keeps saying circumstances have changed

Every time the CSA are about to set up taking payments from XH wages he tells them his circumstances have changed. That sets off a 3 month investigation again and i have to wait each time. This will be the fourth time in 18 months he has done this. Each time before they came back with no change after taking 3 months to investigate. The CSA have said even though they are sure it is malicious they still have a duty to investigate. He is using the system. Is there anything i can do?

Is he paying maintenance in the meantime? If the CSA has allowed arrears to accrue you should challenge them over that. Get them to apply for a liability order for arrears, or get a realistic deal in place for him to pay them off over no longer than 12 months. Get a sympathetic handler at the CSA on side.

Otherwise there's not much you can do about it.

The CSA have said there is a possibility of enforceing outstanding arrears but its down to the 'discretion' of the case worker. I have tried to contact the case worker in the past and they don't return calls. Its a nightmare trying speak to anyone who can actually do something in the CSA!

Oops - No he is not paying anything at the moment.
