Witness statements in court before final settlement

These must be presented in less than 3 weeks. Do the witness statements need to be backed up by documentary evidence (bank accounts, mortgage accounts etc) at the same time or can they (the evidence) be taken and presented on the day or the final hearing?

NB Regarding division on house jointly owned and other properties. (unmarried couple)

Is this for your BIL who has a solicitor anyway?

Yes it is for BIL. We want it watertight and solicitor cannot access docs for the sale of his previous house (we have to) as ExP is saying she put capital into the deposit and he put nothing else.

She is claiming a greater share.

Solicitor is frequently not contactable - as today for example!. Judge also rounded on her in court as she hadnt mentioned in BILs first hearing his 16 year old daughter which self repping exP did! She also said there was aggression on both sides even though not true on BILs (to avoid mediation) (which did work!). ExP is now using this as a reason not to let BIL and estate agents into house for independent valuations.

Sad BIL just wants everything absolutely watertight and refutable with proof coming out of his ears but less the 3 weeks to gather it.

Thanks BHTB it confirms we need to start contacting banks etc for documentary evidence.

His bloody solicitor is always off on holiday and not contactable for the past 2 days for him to ask (left voicemail). Sorry sorry SORRY not meant to rant. We know time is short to get all these documents together - need copies as the ExP wont let BIL have anything from the house. Writing to banks etc mortgage company.(3 weeks allowed from first hearing to all statements in). His solicitor also did not give him a copy of the court documents from that hearing which self repping ExP got. What the hell do they say???! Cant get hold of sol. to find out! He got bill £450 for court today to add to his other fees Sad Self repping ex says she wants him to pay for a solicitor to represent her at final hearing. ha ha ha [emoticon for BIL in a straightjacket]

Apparently just found out solicitor away on holiday and not back til tuesday. 3rd holiday in 2 months. [no comment emoticon]

All you lovely solicitors here have been far more help than her Grin

2 weeks today to get everything together. Shock
