maintenance for over 16's

my partner's ex has moved to malta with their 16 yr old daughter - she has left school but is planning on going to college in september. Does my partner still have to pay maintenance? Can anybody help?

Look at the consent order. It normally states that child maintenance continues until the 18th birthday or finishing secondary education, whichever is the later. Not sure whether Maltese college would count as secondary or tertiary education, but I'd expect the mtce to continue until at least her 18th birthday in any event.

If there is no consent order, because they weren't married, and no CSA assesment he may not have to pay, but I'd imagine would feel morally that he ought to continue until she's 18.

Thanks, she has left school, but hopes to go to college in september - i take it this is classed as full time education and he would still have to pay?

As I say, look at the order. It will specify secondary or tertiary education.
