Moving house - Advice needed

I am being purposely vauge on this so apologies in advance.

Due to exchange contracts on our house (sale and purchase) next weekend. Moving the following weekend. We had a notification of planning request through the door yesterday. The shop next door to us is being turned into flats, which in our opinion is an improvement as the shop is currently very tatty and run down.

But... when we filled out the paperwork for the solicitors about 2 months ago (asking if there is any plans to develop the area around our house), we knew nothing about this so obviously didn't declare it.

The dilemma is now:

  • Do we phone our solicitor and tell them, and get them to notify the buyer of our property. This could potentially bring the whole chain down if he then doesn't want to carry on.
  • Or (as my Husband has said) his Solicitors would have done searches in the past month, it is up to them to find any planning permission or developments in the pipe line.

The buyer may already know, but we dont know that for sure. Our parents say keep quiet, not our problem, it was up to his solicitor to find this sort of thing out. I'm just worried that someone is going to find out in the next week and it's going to scupper our plans.

Can any one on the legal side of things advise me if we are in any way legally obliged to notify someone.
