Harassment order

Without going into too much detail as to every incident but myself and other family members have suffered harassment from a particular family member, we have contacted the police on 4 different occasions in the past 6 months but things are hard to prove...Please can anyone give me advice as what to do...shall I go back to the police or a solictor?

ps I also have 50 pages of emails which have been sent to me threatening to destroy me and my business

You need someone with legal experience to come online.

I think there are two routes you could take, private law or via the police. I find it hard to believe it would be hard to prove harassment with 50 pages of emails as evidence. Why have the police not taken any action? You must be very worried.

I would advise you to go back to them in the first instance. Has the person involved had a warning?

You can apply for an injunction under the protection from harassment act if the police won't act - see a solicitor.

Much depends here on how you are related to this family member. If you can satisfy the "associated persons" test you can apply for a non-molestation order, under the Family Law Act 1996. This is only reserved for close relatives (partners, children etc). If the family member is more distant, you may have to apply for a restraining order, under the Protection of Harassment Act 1997.

In order to qualify for a restraining order, you need to establish a "course of conduct" (i.e. more than one occasion).

A good family law solicitor will be able to fully advise you. If you are financially eligible, legal aid is available.
