EBAY sale going sour

(I have started a thread in ebay too, but hoped that someone here might be able to help Smile)

I advertised a piece of machinery BNIB that I had had sitting around for some time but never used due to the unexpected closure of my business some 3+ years ago. BNIB because that's what it is - never opened or used or anything; photo of unopened box on ebay, collected and now the buyer has got it and says that it doesn't work and it'll cost him £500 to get a new part - AAARGH!
So he paid £1200; current list price is £6k but priced for ebay ie superceded model and no warranty. I think it's caveat emptor on ebay, and I certainly sold it completely in good faith, could not have known whether it would work or not as never used it.
WWYD? Any legal eagles know the situation, given that I am a private seller, not a business?

I think you were a bit bonkers not to have tested something that has been sitting around for a while before selling it.
I would check on Ebay regarding their terms and conditions and what the sellers responsibilities are.
The buyer should be able to expect the purchase to be fit for purpose but as you are a private seller you may be exempt. It depends on ebabys terms and conditions of sale.

Ebay relies on people to sell honestly and their system of feedback is based on this honesty. Your feedback following this will be lousy I think.

You could be taken to a small claims court of course by the seller.

If the money went into your paypal account it will be refunded by eBay when he opens a dispute.

You need to resolve it with the buyer.

Ask him to return it to you for testing
