Gullivers World - where do I stand?

My daughter came down with chicken pox days before us going for a family day out to their winter wonderland the weekend just gone. I have been ringing them daily for a refund. I sent documentation from the dr stating she was too poorly to atttend and only yesterday I received a reply from a member of managment saying that they operate a non refund cancelletion policy under any circumstances. I am not bothered about the money ultimatly but the principle now. Surely its a statuatory right if the cirumstances are medical. I am clueless on the legalities so hoping someone could set me straight and let me know my position before i reply to the email and make an eejit of myself.

I don't think the circumstances matter at all. They don't have to refund you if the terms and conditions state no refunds under any circumstances.

I'm not a legal expert but I doubt that there is a statutory right to a refund. I think it's bad luck and under the circumstances I would have have asked for a refund too. But I think they are within their right to say no. Hope she's better soon.

I think they did. Just wish I hadn't wasted the last 10 days ringing them daily and being told I would be refunded with a dr note but the manager would have to issue it and then getting the email from the manager saying this isn't the case. Communication at its best between staff and management . Thanks tinsel

Agree that there is no legal right if their T&C say no. However if you can be bothered a letter to MD or equiv stating how you were originally misinformed and so spent much wasted time on follow up calls and drs notes might persuade them to make a goodwill gesture!

Yes she is much better thanks...never thought you got that poorly with chicken pox as my DS never did. Just carried on as normal with spots. DD has been ever so poorly, high temp, runny nose, off her food and generally very upset. thankfully she is alot happier for Father Christmas coming which is the main thing. If I'd have known I would not have got a refund I would have given the tickets away to family or friends rather than see them go to waste. This is what is now really annoying me. In hindsight I should have just stayed home with DD nd let DH take DS but DS didn't want to go with me and DD.
