Both me ad my DH are a bit clueless about legal stuff and was wondering if anyone could help. We found out today that bailiffs have been trying to contact my DH at an old address as they have a court warrant. The warrant was issued as he has't paid car tax. The car was scraped before the date the tax was due, the scrap yard said they would do the paper work but obviously didn't. Does anyone know what we can do to 'clear our name?' The baliff is saying that we owe them £500 should we pay this to 'get them off our backs? Im really worried about the affect this going to have on our credit rating (we were thinking about moving within the next year)

No don't pay them any money, go down to CAB.

Contact the scrapyard and ask for the paperwork to do with the scrapping.

The scrapyard should have given you a Certificate of Destruction when they took your car. If they did not do so you should have completed the "Notification of sale or transfer" section of the V5C (registration certificate) and sent that to DVLA.

In addition to consulting the CAB I would suggest contacting the DVLA and explaining the situation to them.

Just wanted to day thanks for your advice the other day - we've spoke to CAB and the magistrates. We've provided everything in writing to the magistrate and are waiting to hear back.
