I was rear ended at speed-enough to write off my car and leave me with whiplash and some very unpleasant symptoms.The third party admitted liability immediately,as did the third partys insurance company.I have arranged to buy a new car which is not going to be ready for 2-3 months.Meanwhile I have been provided with a hire car.My circumstances are very difficult,both my dh and ds are severely disabled.My ds is a wheelchair user.Can the hire car company demand the car back?I cannot manage without a car and we have already been greatly inconvenienced through no fault of my own.I have legal cover and replacement car cover on my insurance.The car is £38 per day to hire and I dont want to have to hand over a large amount of money after a couple of months.When I called in the garage that had my written off car stored there was a sign that said Remember you should not have to suffer any inconvenience if it is the third partys fault` It then stated all these legal precedents.I would welcome your comments please,as on top of everything else I am worried sick I am going to have to hand the car back or be landed with a big bill.Thank you.

speak to your insurers.

If the 3rd party's insuress accepted liability you will be ok. Can't see the hire car company demanding it back, they are making money after all.

The time issues arise are when a 3rd party's insurance dispute a claim and will not settle the claim in full.

The supplier of the current relief car may ask for it back after seven days. If so, ask your Insurance company to make arrangements for you to be supplied with another one.

same thing happened to e last month. and the terms of the hire car contract was that it was Mine until i got the cheque.

then 7 from receipt of cheque, as i could thn go and buy a car.

in your circustances i would speak to your insurers and your solicitor

i suspect that your solicitor will say that this counts as out of pocket expenses and can be claimed as part of the settlement - but if you might have to pay upfront>?

Hi there,hire car has gone,insurance company say they have discharged their legal duties.I am trying to get a new car quicker,the only reason for the delay is that the colour i wanted won`t be ready for 2 months,therefore it was my fault i suppose for being picky.Thanks very much for taking the trouble to reply.

New car company are giving me a hire car free until my new car is ready,I had to change the colour to get the delivery brought forward.
Should have my new car next week Smile
