Faulty bag with no receipt bought from concession

GAH

This morning my beloved (but not much used) Mint velvet bag strap snapped.

I bought it in April, and of course I have NOTHING to prove when or where I bought it
but it was at a Mint Velvet concession in my local Dept store.

Do I need to prove I bought it there?
The floor managaer of the ladies dept said I coudl take it up with head Office or take it to a stand alone store (nearest WINDSOR, no thanks)

What should I say to the Mint Velvet manager when I see her on Monday?

Can you not show a debit on your bank statement? If you can find the date and time of the transaction they should also be able to confirm that the transaction took place.

Their argument will be that the time lapse is unreasonable.

If it's their product, you couldn't have bought it anywhere else and it's faulty then they are obliged to repair, replace or refund. You don't need a proof of purchase because you couldn't have bought it anywhere else. They may ask for proof of the date you purchased it because the rules change after 6 months but a credit card statement will be sufficient.

Mint Velvet have concessions at House of fraser too(as the ladieswear manager was VERY keen to pint out)and also I could have bought it onlne I suppose

I think I am going to have to rely on the Mint Velvet concession managers goodwill on Monday....

It's the same company so you should be able to return it to any of their shops. Start mentioning the sale of goods act if they are being difficult.

Your legal rights are against the retailer, not the manufacturer. Whether you can take it to any of their shops other than the concession where you purchased the bag depends on their legal structure. If the concession is operated as a franchise, for example, your rights are only against that concession.

Legally you don't have to have the receipt when you are returning goods for a refund or replacement. However, if the retailer denies that you bought the goods there you would need some form of proof to go to court. Your bank statements online may not go back that far (I'm a bit surprised by that!) but they can probably supply statements going further back.

Start with the Mint Velvet manager by simply setting out the facts. Many shops will reimburse or replace without a receipt. Your difficulty will come if the manager refuses. If it isn't a franchise you can try other branches or write to head office. The manufacturer may be prepared to be helpful anyway.
