Disappearing Sofa

My DD lives with her partner and needed a new sofa. My MIL offered to buy her a second hand one from a friend of hers for £250. My DD went with MIL and paid over the cash. As the old couple said they had a week or two to wait for the sofa, my daughter said she would wait until their new sofa was delivered. They kept the cash. The couple said they would arrange for the delivery men to take sofa to my daughters.

Weeks went by and my DD was given numerous dates but sofa never arrived. Today she waited in all day and then rang the sellers. To her horror they had let the delivery driver have it as he said he could not get a reply from my DDs. DD adamant she was in all day as by now she had waited nearly 6 weeks.

No note through the door,no phone call, no nothing. Old couple said my MIL could have her money back. AS yet, she hasnt got it.

MIL rang the company who had taken the sofa, pointed out that it was her sofa, she had paid for it and they had no right to take it. They said they had it in their store around 100 miles away and that if my DD wanted it delivered back she would have to pay another £140!

What a mess. Does anyone know where the family stand? Is it theft for example?

The trouble is there are three parties involved, at least two contracts.

You probably realise by now that your mistake was to hand over the £250 in advance. You would have been better to say Cash on Delivery.

if the couple say she can have her money back, all well and good, get it back and spend £140 of it to get it delivered.

DD can always give the old couple what is left over from the £140....
