mortgage transfer, help!

During my divorce process, I asked my bank if they would transfer the mortgage to my name, and take my xh's name off. They would not, as although I have been paying mortgage on my own for 2 years I am unemployed, fair enough.

Now the divorce is finalised and I get to stay in the house until my ds leaves school then have to pay xh 40% profit of sale. I have just got a letter from my solicitor asking if I have made enquires with regard to the transfer of the mortgage with the bank.

Will the bank now take his name off? Do I need to get in contact with them again? I have, by the way tried phoning both sol and bank today, but no one availiable, what do I do next?!

How have you been paying the mortgage if unemployed?

If you are still unemployed they will not remove his name as you have no means of meeting the criteria for a mortgage.

to have a mortgage you have to evidence that your income justifies the loan. the bank won't just sign the loan over to you without this.

i assume she is unemployed as she is takes care of her child and can't work and justify the childcare costs - correct? the mortgage must be covered via alamony payments.
