if exP doesnt turn up to financial hearing what will happen?

have court hearing date to apply for sale of joint owned property under TOLATA (were not married) - i moved out with DCS (due to his bevhaviour abuse etc) and am renting - since April 2008. concurrent childrens act case to get lump sum from sale for me to house children - ie i would like my share of euiqty (plus whatever) to be able to buy a new property.

exP doesnt want this to happen but has said he wont come to court to contest = "because what you are doing is wrong". so what will happen? will they decide in my favour in his absence or ?

he cannot buy me out as not working.
