Advice needed on mobile phone contract - where do I stand?

Short story:
I recently upgraded my handset to a Blackberry. I asked before I requested the handset if there were any extra charges. I was told there wasn't. My contract was changed to a £40 + 5 insurance one, an increase from my previous contract, but there we go, I accepted that.

I got the handset today. It doesn't have internet. I rang the company. They told me that I have to pay an extra £5 a month for it, a special charge.

I hit the roof, especially after having spoken to two people and specifically being told that there was no extra charge and that my bill would be £45 a month. It will now be £50.

Where do I stand legally on this? There will be records of the phone conversation (I know this as the first woman I spoke to said she'd need to listen to them before calling me back).

If you are still within the first 7 days you can cancel your new contract and send the phone back

that is probably your best option and then you can find a new better value contract

moneysavingexpert is probably also worth a look

Out of curiosity, which company is it as DS is looking into getting a blackberry and is currently looking around at various different deals.
Hope you manage to get it sorted ok

It was Orange.

I rang this morning (after sleepless night!) and spoke to someone who was confused as to why I had been sold a blackberry without the vital part that makes a blackberry.. a blackberry.

She changed my contract on the spot, and I am now paying what I was before. sorted, and thank you eldonave for the link, it was very helpful.

I (stupidly) let DS bully me into letting him get a blackberry on contract with me being guarantor. Got it yesterday and this morning when I was driving him to some relatives where he is staying for a few days he announced that he can't get a signal!
He specifically questioned this and the company apparently checked our postcode and 'guaranteed' he'd get a signal.
Well he can't! Fingers crossed we will be able to return it with no problems. Watch this space.....
