Hi. Does anybody know if deposits are returnable if the item is not got?

E.g i paid a deposit for someone to hold an item for me, now no longer need item and have let person know and they are refusing to return deposit. There was only 2 days between whole process, (from me viewing item, and paying to her declining deposit back) and plenty of time before remaining balance was due.

I could really do with the money back, but don't actually know who is in the right here.

Any one got any idea

Thanks in advance.

Do you have any terms in writing, or on the receipt ? Usually you could expect to forfeit part if not all of it for cancellation unless there is a cooling off period.

I may be wrong - hope so for you - but I think the point of the deposit is that you are saying effectively "I want this item and I am staking money on getting it" ie, the deposit is to ensure against you changing your mind iyswim?

No terms etc.

Was it a private sale?

Or was it a commercial transaction?
