The deposit should be held in the rent deposit scheme, the Landlord can not move anyone else into the property until the contracted date, this is classed as an illegal eviction, even if they first tenants are not living there. If the landlord thinks that they have abandoned the property then he needs to post a note on the door and leave it a certain amount of time (can't remember what this is off the top of my head, think it's 14 days)
