Thank you for your email regarding an article in the Daily Mail of 30 April by Esther Rantzen.
The Commission has received numerous complaints about this article. However, the first point for the Commission to decide will be whether it can take a complaint under Clause 3 (Privacy) or Clause 5 (Intrusion into grief or shock) from someone unconnected to the McCann family.
This is because much of the complaint will rest on the alleged impact of the article on the family at this time. According to the PCC?s standard procedures, it would be for the family to say whether they object to the article and to make a complaint; we must, primarily, respect their views on the subject.
We have been in touch with the McCanns on several occasions in the past few years and have acted on their behalf in regard to privacy matters. They are fully aware of our services. We have not been contacted in regard to this piece.
Against this background, an initial examination of your case suggests that you are a third party to the complaint. However, if you believe our normal rules should be waived to allow us to take your case further (or if you do not consider yourself to be a third party in this matter) we would be grateful to hear from you in the next ten days.
If, at the end of the complaints-process, you are dissatisfied with the manner in which your case has been handled, you should write within one month to the independent Charter Commissioner who will investigate the matter and report any findings and recommendations to the Commission.
