Nightclubs can let in those who fit the purpose of the event. So they can bar drunks since that is a reason. They can bar over 30s on a night advertised for 20-30s etc. They can apply a dress code since that also fits the purpose of the event.

They can apparently bar people who are not good looking enough. I think that one is morally shaky and anti-social, but like a beauty contest has a reason of sorts.

They can't openly bar someone for reasons which are purely discriminatory.

amberlight · 06/04/2010 12:29

No, nightclubs can't. They are absolutely bound by the same anti-discrimination laws as everyone else. You cannot turn away people because of disability, sexuality, etc. Other criteria are not bound by the law. Those are. That is the difference.

And no they can't get round it by turning away all the e.g. disabled people by saying it's on the grounds of them all being too short/tall/fat/whatever. If it's a pattern of no disabled/gay people, they're in trouble.

Nightclubs turn a way groups of men all the time! I would say that is fairly discriminatory.

(This thread is completely in bold font for me, is it the same for anyone else?)

atlantis · 06/04/2010 12:35

I've posted on here before about my brother and his LP and spoke to him last night and he informs me there are numerous websites for finding 'gay' friendly B&B's, one in wales (something to do with a rose?) that is gay run (that they use, apparently it's a little slice of heaven if anyones interested) and assures me that straight guests are not welcome in a lot of 'gay' B&B's, so there's two sides to every coin.

"Yes, you're right actually, it wasn't nice of me to take the piss out of you not being able to spell.."

"do bigots have rights"

The price we pay for living in a society is to give up some personal freedoms that infringe on the personal freedoms of others. No one ever said that was perfect, but there is no other way to work it.

Society makes decisions and passes laws defining those freedoms as it goes along. Attempting to balance the two as best it can.

We decided and ruled that discrimination (because it makes no practical difference to anyone else what color/gender etc you are) is not acceptable and that is the end of it.

Alouiseg · 06/04/2010 12:40

"and that is the end of it"

Are you the official mn thread closer onagar

I find that other peoples rights annoy me soo much that I start to have prejudices where none existed.

TheHeathenOfSuburbia · 06/04/2010 12:48

Jeez, alouise....

Is the right not to be discriminated against really that offensive to you?

onagar · 06/04/2010 12:48

The end of it as far as the law is concerned. you may campaign about it here or anywhere and maybe get a change in the law. What people can't do in the meantime is to break the law because they really want to.

I may sometimes sympathise with your irritation at 'other people's rights' but the gender preference of a hotel guest does not affect the quality of life of the owner.

onagar · 06/04/2010 12:51

And yes this thread is messed up. Bold and huge spaces at the bottom.

Maybe if I do a bold it will reset it?

onagar · 06/04/2010 12:52

Nope*

atlantis · 06/04/2010 12:53

Sorry half post with a knock at the door..

"Yes, you're right actually, it wasn't nice of me to take the piss out of you not being able to spell.."

I wish I were able to tag my posts with please excuse my spelling and grammatical errors as I am a dyslexic who gave up on english classes, but alas I can't.

As for my 'vile' views, why are my views vile? I haven't said it's ok to discriminate against anyone, what I have said is that a B&B is primarily a 'home' and so it's a grey area and I believe the law should reflect that.

Mumsnut · 06/04/2010 12:55

Bet Grayling gets the push today.

daftpunk · 06/04/2010 12:58

Why do you think that..?

Don't know anything about Grayling that I haven't just heard today. I'm told he votes in favor of gay rights etc so perhaps not a homophobe and just a difference of opinion.

He is still wrong imo, but it's ok to have a different opinion. Depending how you use/apply/publicise it of course. I don't think anyone suggested he was frothing at the mouth and demanding that gays be barred from everywhere.

Mumsnut · 06/04/2010 13:45

Daftpunk, because my general impression (I haven't been keeping score) is that DC gets rid of party ministers / spokesmen pretty sharpish when they go off-message.

stickylittlefingers · 06/04/2010 13:55

why on earth would it be OK to discriminate from the comfort of your own home? Is that OK only in relation to gay rights (or lack of them) - i.e. would it be acceptable or unacceptable for me to run a whites only B&B?

I don't see how it makes a difference?

sorry, not at all obvious to me - all seems to be deciding to be obnoxious to one group of people for no good reason. The law now says that you can't discriminate - deciding that you want to interpret the bible, or any other religious work, in a manner that means you think you can get away with discrimination does not wash, nor should it.

daftpunk · 06/04/2010 14:09

Mumsnut;

I'd be very suprised if he gets the push...but if he does he can always give Nick Griffin a call.

Amen smallwhitecat - you've put it so eloquently!

When someone has an opposing view to your own it does not automatically make them a bigot/racist/Tory. The Left is getting somewhat "Stalin-esque" with their "you must be liberal or go to jail" rhetoric.

onagar · 06/04/2010 14:41

It's ok to BE prejudiced (though really stupid since it makes no sense whatsoever) but not to act on it. So if they are prejudiced they can't run a B&B. Once they stop it being a B&B they can choose to only invite in who they like.

They should have thought of this before they started it.

Alouiseg · 06/04/2010 15:13

Which may be why small businesses are being strangled by bureaucracy, rules and red tape.

Surely if a person runs a business and they let in who they so choose without having to regard rules then it is up to them. The market will decide whether that business flourishes or dies.
