Hacking charge for husband who logged into wife's email account

in the US. I'm with the husband - hope he gets off.

It's interesting though - there are so many threads on MN where the poster freely admits to looking at the DH/DP's emails/FB messages/texts etc and 95% of the time I don't think anything of it - or if anything, I think "fair enough". And this case hasn't really changed my mind - but on the face of it, I shouldn't be thinking this. I guess the wife in the case sees it as akin to reading her diary.
