Process for de-registration at special needs school

Hi. Does anyone know what the L/A process is to de-reg son from a special needs school? How long it takes etc? It’s East Sussex Thanks

I believe Education Otherwise has a fact sheet on this, and can give good advice on what to do if the LA drags its heels.

You need to request permission to deregister. That isn’t quite the same as permission to EHE. Permission should not be withheld unnecessarily. If they do refuse, you can go to the Secretary of State. The legislation is changing ever so slightly next month, but if DS is compulsory school age and in a SS funded by the LA, you still need permission to deregister. Send a letter to the school and LA setting out your intention.

The LA may try to tell you, you will become responsible for providing the provision in F. That isn’t true. Although by EHE the LA is not responsible either.

Occasionally LAs will agree a personal budget for those EHEing but they don’t have to and it is uncommon.

Rather than EHE, have you considered pursuing another placement or EOTAS?
