children's passports being withheld by an ex partner
Bachy · 15/04/2021 20:24
Does anyone have any experiences regarding renewing their children's passports when they father is with holding them and refusing to return them.
Thank you.

I think you have to declare them lost/ stolen.
Then apply for new ones.

You do not declare them lost or stolen because they are not. It can end up with all sorts of problems.
Is there a reason why your ex wants to hold onto them (apart from being an arse?). If not then you can apply to court to have them returned to you to allow for travel. However, you need the permission of your ex to take them abroad anyway and he can go to court to prevent you from taking them if there is good reason.

I had and still have this problem, although he’s loosened up a little over recent years. I exchanged many letters with the passport office. If he has parental responsibility then he is allowed to hold the passport, and if he won’t hand it over you will need to apply to court. Good luck, I feel for you
