Applying for DC's first passport with deed poll

Just wondering if anyone has successfully managed to get their DC's passport in their current name, when the birth surname has been changed by a deed poll signed by both birth parents?

DS1 is 5 and I'm applying for the passport using only my details (XP's whereabouts now unknown). His birth surname was changed by deed poll to match my married name - XP signed the deed poll agreeing to the change, albeit out of nastiness more than out of any desire to be cooperative ('I don't want anything to do with the little bastard now blah blah blah'). The deed poll hasn't been enrolled or notarised, but it's been accepted by our GP, the school, and the benefits office with no issues.

Are the passport office likely to accept the deed poll and issue the passport in the 'new' surname?
