There seems to be some confusion on this thread. Guyonhere1 and GreenTulips are at cross purposes.

The WhatsApp APK can indeed be downloaded and installed on a tablet as Green Tulips suggests. That is the current official version of the WhatsApp app (APK is the format in which Google apps are distributed). Installing it on a tablet is perfectly legal. However, it won't do what you want. You won't be able to use the same account on your tablet as you do on your phone. You would need to create a separate account to use on your tablet whereas you want to use the same account as you have on your smartphone.

Guyonhere1 is referring to the various mods which are available. These are indeed illegal. They have been built by modifying WhatsApp source code without authorisation, which is a breach of copyright. There is no way of knowing how secure these mods are and Facebook (who own WhatsApp) regularly ban users they find making use of them. I would keep away from them.

An alternative is WhatsApp Web. This is not an app. It is a website you access through your web browser - web.whatsapp.com/. Through this website you can use WhatsApp through your web browser using the same account as your smartphone. However, whether you can use it depends on how broken your phone is. If the camera is working and you can open the WhatsApp app you will be able to make use of WhatsApp Web. If not, I'm afraid you may be stuck until you get your new phone.
