What can I do? It's a cheap Samsung, on a cheap 3 package and I've got no insurance so I don't think they're going to be nice to me about it.

Can I buy a 3 PAYG handset and use that?

Yes you can. DS lost his smartphone and now has a £10 handset with his contract sim in it.
