The way I'm reading it is that there was a challenge to the withholding benefits, but the court says it is OK after all?

The withholding of benefits is an unwise move from Cameron. Once people are in our country I think they should be treated with respect. I don't think withholding benefits will deter people from coming to the UK as they'll just stick it out until they do get benefits. I want to Leave the EU for democracy, and a fair country which doesn't condemn people to poverty. So Cameron is wrong if he thinks that's an incentive for the "leave" side to switch to "remain".

I think you need to read the article because it doesn't say what you think it does.

The European Court of Justice said it was lawful for the UK to withhold benefits to migrants if they did not have the right to reside in the UK.

I think it means the UK can deny benefits to certain eu migrants. The European Commission challenged Cameron ' s position. And lost.

The ECJ has ruled in Cameron's favour - it's legal to deny child benefits and tax credits to claimants who do not have the "right to reside" ie do not meet the criteria for free movement.

It will be interesting to see if this error (which I am sure was a genuine "read to fast and with my brexit glasses on" error, rather than a deliberate attempt to mislead) ever gets acknowledged by the OP.

It is interesting that the Commission were challenging the position that Cameron sold to the UK as a done deal though. Obviously the Commission aren't happy and the timing of the challenge is pretty poor.

Yeah - what a system where the commission can challenge individual countries if they think they are acting like prats. Can't imagine that is ever useful.

This EU court decision concerned a residency test they ruled the UK could use a test to stop EU immigrants claiming child benefits for kids abroad if 1-they were unemployed & 2- they did not have the right to work in the UK

That is the problem, EU immigrants do have a right to work in the UK so the test will stop hardly any EU immigrant claiming child benefit for kids abroad, the latest figures said it cost the UK £31 million to kids abroad a year

Yes a lot of people seem to believe the small changes he negotiated were guaranteed! "But of course we won't have to do X, Cameron's deal exempts us"
