Deferred payment scheme.

Hi. My aunt has gone into a care home with dementia and won't be coming home again so we have put her house on the market in order to pay for her care home.
Her LA placed her in what I can only describe as a hell hole so we moved her to a much better home and she is now thriving

Her liquid assets will hit the threshold for the deferred payment scheme early next year and we have yet to find a buyer so it looks like we will have to use the scheme for a short ish period of time.

We are aware that the LA will only pay a certain amount towards the fees in that agreement which would be fine as we should be able to top it up .

My query though is whether we would be forced to move her back to a LA home whilst on the dps on the basis that she will ultimately be paying the whole bill. If her funds were to run out and the council paying, I could understand that she wouldn't be able to stay there but with the sale of the house, her funds should last until she's 99

I did email her LA but have had no response.

Thanks

The local authority absolutely will not want her to be moved.

Don't forget about the 12 week property disregard as well.
