Hi all,
I’m hoping you can help me with some knowledge.
My Uncle has been in a care home for nearly 4 years, self funding for the first couple of years & then funded by local care/care. He died at the beginning of this year, room cleared out etc.
Now the aunt (70’s) has decided she’s going to move nearer to relatives in a complex for older people, she’s worried that if she downsized the council will want the money from her proceeds that the council paid for his care, are they able to do this?
I’ve tried to ‘google’ this, but can’t find a definitive answer? Any ideas?

Was there a charge put on the property?

I don't think she's right. If she were, there'd be a lot of people losing their inheritance by having to pay care home bills after selling a relative's home after death, and I've never heard of that happening.

Not as far as I’m aware? I’d have to ask her, my thought was that ‘a debt died with someone’ but I really don’t know.

No. The value of a property is disregarded if a spouse remains living in it. Now uncle has died and his estate completed, it's a done deal now.

Thank you, I’ll pass this on to Aunt.
