Have I got any chance of an appeal and what would you do?

We moved to a very rural village in August. We didn't get a place at the local school as it was full and my DD1 had to start reception elsewhere, a good 8 miles away. She had gone to preschool there so we decided to keep her there. We were hoping to get a place this year as DS1 starts reception in September, but nobody has moved or is likely to move this year and the class is full at 30 kids. Now my dilemma is: what do I do? I can't do 2 school runs as both schools start at the same time + I need to take the other 2 kids to a nursery elsewhere, so I would be doing 3 school runs, which is impossible. Do I send them both to the school 8 miles away? That would mean giving up altogether on the chance of them attending a local school. If I appeal will I have any chance of succeeding, if the class is at 30 already?

(PS I looked into other local schools, one a catholic one about 4 miles away is full and the other one only has 30 children in the whole school and it seems a little of an odd setup).

I think you might have a good chance of getting a place on appeal. Our village school ( I was a governor at the time) had a similar problem a couple of years ago - they had 30 children already in the class but were forced to take an extra child because of logistical problems - the mother had two children at different schools. Good luck

I think you can look at the whole school rather than just the class to determine whether there is space for your dc.

Contact the children's legal centre, I think they give free advice about this.

will your DD be in KS1 or KS2 in September? - just thinking that as KS2 (yr3 upwards) removes the legal maximum of 30 in a class that applies at KS1, which would increase your chances at appeal.
