How do I get copy of my daughter EHCP?

I have emailed the school but they are ignoring me. It was granted a few years ago when DD was in year 6 but I can’t find it.

We are applying for another school and need copy of this plan.

The council will have a copy. Have you not had yearly reviews? Ours get emailed now - a draft then the final version

You should receive a copy every year at the annual review. My LA email the reviewed ones out, can you search your emails?

If not, email the SEN team for your LA. This should be google-able!

The LA only has to send amended versions following annual reviews if they propose to amend.

When you say you are applying for another school, do you mean you are planning to make your own arrangements at an independent school? Because if not, you should have a draft amended EHCP prior to you making representations and stating your preferred placement.

Thank you. I have emailed SEN at the LA. I have not received anything from the LA since she got the plan 3 years ago.

We do have annual reviews with the school and they emailed the reviews but not the plan.

Will search my emails and keep chasing

Not; we are applying for another state school which has year 10 entry. The school requires us to attach the plan as part of the application process.

There have not been amendments to the plan since it was issued.

You can’t just apply for another state school in the same way you would if DD didn’t have an EHCP. You will need a review of the EHCP.

Just checked my emails and the SENCO person sent it; she also said she got an email from the LA who told her they have an updated one.

The strange thing is that we never received anything from the LA before; only now because I chased. It seems they have forgotten us. Can they change things without telling us?

Why do I need a review plan for the new school? Do I inform the LA of the new application. She is in mainstream school

If she doesn’t get into new school we still need the place at current one

The LA must not amend the EHCP without you knowing. They must inform you of the proposed changes, give you the chance to make representations, then send the finalised EHCP to you.

You need a review of the EHCP because of how admissions with an EHCP work.

At the review meeting, you will be able to make it known you wish to move placements. Following the review meeting the LA will agree to amend (or not). If they agree to amend, they will inform you of their decision and the proposed amendments. You then get the chance to make representations and state your preferred placement. Then the LA will consult with placement(s). Then you will get the finalised EHCP, which may or may not name your preferred placement in section I. If the LA doesn’t amend or amends but doesn’t include the amendments you think are necessary/doesn’t name your preferred placement you will be able to appeal.

When was the last AR? You can request an early review by sending one of IPSEA’s model letters to the LA.

The EHCP is updated at least yearly and there is a part for parents and the child to complete about what they want to accomplish and new targets set.

You should have met with the Senco at least termly to have an update at the primary and now the secondary school.

When you applied for year 7 there would have been a meeting and discussion about naming the school. There is a separate process for EHCP children. There would have been a transition period between schools. What arrangements were in place for year 6 SATS and how do you know the child needs were being met in year 7.

Are you sure it was not an IEP that was used?

The EHCP is reviewed at least annually. This does not mean the EHCP is updated/amended each year. Many are not.

We only get annual meetings with the school. Don’t hear much from them the rest of the year. Haven’t heard from the LA once since we got the plan.

Apparently there is now a reviewed plan, probably because I sent them am email asking for copy of the plan.

Did she achieve any of her outcomes at the last review? If so and new ones were agreed then this will be the 'new' section they are referring to. Ask them for any copies that they have plus your review information. Ring the LA directly and ask them to send it to you as the school are being obstructive.

Then the LA is not following the correct procedures for the ARs and amending the EHCPs. The LA must inform you of their decision (e.g. whether to maintain as is, propose to amend, propose to cease to maintain) following the AR meeting. If they are going to amend, they must inform you of the proposed amendments, give you time to comment, send you the finalised amended EHCP. It will help you to read IPSEA and SOSSEN’s websites so you understand the process better.

Thank you. Will contact school and LA; not sure which one is worse. I know they are overstretched but not sure what to think anymore
