sent wrong ebay item, bit complicated. advice please

i bought a buy it now item for my daughter's birthday. it was an in the night garden cd.

the weekend after i received quite a few parcels - some gifts from relatives, some ebay etc stuff i had bought. one was a set of ITNG books. it was delivered in amazon package.

i did briefly wonder whether it was a mistake from the company i had bought the cd from. But the order note said it was a gift from x_something else (does that make sense? basically, it was a letter, underscore, something else) so it could have been the moniker of a number of uncles/ aunts etc. also, it wasn't my paypal address. that kind of swung it for me, cause there was a different postcode to the one i use. so i assumed that it was from dh;s uncle or someone else.

cd still hadn't come after a week. contacted seller. they are completley refusing to do anything other than refund dif in cost (books cheaper i guess). i have opened books. no reason not to.

i am really pee'd off. what should i do? i have offered to return books used.

I'm not sure what has happened here.

Has the Ebay seller ordered an incorrect item from Amazon and had it drop shipped to you? Or, have you not received the item at all?

If you haven't received the item at all, then you are entitled to file a dispute via Ebay/Paypal for an unreceived item (despite what the seller is telling you).

If the item has been drop shipped from Amazon then you can still also lodge a dispute through Ebay/Paypal as you did not receive the item that you paid for (it doesn't matter if you have opened the item or not).

Claim through PP as item not received, simple as. Tis is their own fault for trying to be clever (a pain if you ask me) some sellers it seems, do not have the items in stock. They then order it from Amazon when you buy (where it is poss slightly cheaper) and have it sent to you.....silly IMO as the seller is still responsible and they didn't even personally send it. Please, just claim as item not received.
