Right will try and keep this brief.

Sold a lovely coat on ebay that I had worn once to a wedding it was in fab condition

Sold it, posted it off, buyer received it said it was ripped and therefore unwearable wanted a refund. buyer offered to post back but wanted to charge me postage.

i said that it was strange it was ripped as i checked before packing and was fine. also said that i did not want to be out of pocket and told her to keep it and bin it - as if it was ripped that is what i would do anyway.

3 days later she has relisted it as immaculate condition.

..............

do i have a leg to stand on here - is this worth me complaining to ebay about.

yes, definitely report it ebay: you'll have proof that she has complained about it being in less than perfect nick.
(emails etc)

Bloody hell that is terrible.

Definately report her to ebay. She has basically stole it off you and is now selling it on!

Presumably you refunded her?

what keeps going through my mind is if I asked to send it back would she have purposefully ripped it????

If you have refunded her then I think you would have a case for reporting her to the police for fraud (although they probably wouldn't be interested or do anything). If you have refunded her already and ebay don't sort it out then take her to a small claims court to get your money back.

Print out (and save the page on your computer) her new listing now before she has a chance to remove it so that you have proof.

have reported it to ebay but am not hopeful because - i told her to keep it and refunded her money - i should have asked her to send it back IFYSWIM

tbh i would have usually given it to the charity shop - wish i had done now - will certainly do that from now on.

Definitely keep evidence, if you print off the page copy the url as well (bit in the address bar) and date and time you accessed it

not going to police, not sure they would care anyway it would seem such a trivial matter to them and in a way it is very trivial.

but i think that there has to be some sort of reason why people do stuff like this - she might really really need the money.

or she might have genuinely wanted the item, bid on it, got it, it did not fit and she knew the only way she could get a refund was to claim it was faulty/not as described.

i refunded the money and she was left with an item that did not fit, and is selling it on.

this last bit could just be an error of judgement.

i feel like emailing her, letting her know i know what she is doing and asking to donate it to charity.

armbow - I think you're far too kind. I made the mistake of confessing to someone that I was new to ebay when he complained that the changing bag I sold him was significantly not as described. He kept it for weeks (because I wouldn't give him a refund until he returned it) and it was filthy when he sent it back. Unfortunately I was in the middle of having a massive amount of building work done and I didn't really look at it when I gave him the refund. Some people are total bloody chancers basically

they will do something, because she obtaiend goods by fraudulent deception.

she stole from you, full stop.

You were actign within the law by offering a refund for faulty goods, especially as you weren't aware of a fault.

then she has stated publically that the goods weren't faulty.
therefore she has defrauded you.

i hate getting people in trouble.
