If there's a buy it now price that hasn't been passed then I think you can BIN if you want to. Whether or not it's a good idea depends - do you think the item is worth the BIN offer? Do you want it? Would you be more pissed off if you didn't get it, or if you thought the BIN offer wouldn't have been passed in the auction?

if it's got a bid you can't accept a bin

have you checked completed listings to see what similar goes for?

are you happy with the price they have offered?

if so, you can add a BIN as long as there are no bids on it, or if you are happy to cancel your bids. Its against ebay rules, but there is nothing stopping you from doing it.
