Help..sounds familer!, but buyer has damaged an item and wants a refund..paypal say she can have one!!!!!!!!!!!!!!!!!

the item was sold with a defect, clearly eplained and photo's offered..i took great care in getting it to her only to be emailed saying its marked and pulled ALL OVER!!..which it was not!..cut tot he chase, paypal contacted me, i said no refund as already stated in my listing plus she didnt ask for the photos or contact me prior to buying, they come back tonight to say theyve said she CAAN have refund and have told her to send it back to me!!!!!!...firstly, I havent agreed toa refund and THEY havent even seen the bloody dress, previously or now, so how can they sauggest IM lying!??..secondly, i have not authorised them to give out my address, surely theyre in breach of data protection???..i WILL NOT pay this amount and be left with a now damaged beyond repair dress..what can i do now??

will they not just take it out of your paypal account and give it to her?

Must say, I find it hard to understand how they decide. They just seem to go with the buyer all the time without looking into the facts!

The buyer can get your address from ebay in any case, they just have to apply for it and show a transaction that has taken place between the two of you. I have just found this out myself. If you sell to someone through ebay then they, effectivly, have access to your address and phone number in any case.

They will just hold that amount from your account, the only way to stop them getting it is to close it down and make sure no money ever goes in there again - but then you are leaving yourself with a debt to paypal - which they could chase you for.

In short, I don't think there is much you can do!

HI and thanks, there is nothing of mine in my paypal acocunt, they now have me in arrears!!!, i have emailed them informing them I have not agreed to any refund there for I will not be paying any amount back adn again telling them i have clear photographic evidence that the dress was NOT in the state shes saying its in!

reg my address, paypal have sent me an email shoing what they have sent her, and regardless of buyers being able to get it from ebay..PAYPAL have emailed it to her when i have NOT authorised them to do so, so im not a happy bunny!

They can't have an account in arrears as they are not (IIRC) covered by the consumer credit act. I'd contact watchdog, this appears to be a wide spread problem.

It will be in the terms and conditions that paypal can provide your details in the event of a dispute for the purposes of return.

I know you are angry about this but, really, this is the way it is done and you did sign up for it when you started using paypal, even if you did not realise it!

The reason they so often side with the buyer is because the item was yours in the first place and, if it is as you describe, you should have no trouble re-selling it once it has been returned!

Fluffy, it is only technical arrears, paypal actually just tag the account so that the first £x paid in goes straight to them rather than lending the person the money they go into arrears by IYSWIM, it just shows as arrears on your account. They don't actually use credit.

You agreed to have your address made available when you signed up.It's in their T&C (which you probably didn't read. I never do)

As a seller you may have access to the User ID, email address and other contact or delivery information of the purchaser, and as a purchaser you may have access to the User ID, email address and other contact information of the seller."

I had this sort of problem and my account went into arrears for under £10. 6 months later I had debt collector letters and phone calls until I agreed to pay. They will chase you. I hate paypal.
