Could this seller refuse to refund? They have sent the wrong size

I bought a pair of shoes for a party this weekend. In the ebay title it said a size 4, in the description where you choose the categories they chose size 4 and it appears in the details where they choose leather, size, condition.

However in the description lower down which you write freehand they say size 4 EU 36.

They have arrived and they are size 36 on the sole which is a size 3.

Or is this my fault for not clarifying.? So far I've sent them a polite email asking if they've accidentally sent the size 4's to someone else as these are a 3.

Exactly the same hing has happened to me with a pair of boots. The seller has not responded to any of my emails so, not knowing what else to do I opened a paypal dispute to get my money back. I had to go with item not as described, they were advertised as a 7 but in fact a 40 which is a 6 or 61/2. Paypal found in their favour and I did not get a refund and still have had no word from the seller.

So, I am stuck with a pair of boots which are too small. I hope you have better luck.

Actually, small correction, in my case the boots were advertised as a 7 and nowhere in the description did it state eu 40. It was only when I received them I found this out, the size 7 is not anywhere on the boots.

sounds like they made a mistake with the listing, wait for them to respond to your email, they'll probably refund once you send them back

38=5
39=6
40=7
41=8

this chart seems to suggest that a 36 is a 3.5.

Eu size 40 is a size UK 7, that is why you did not win the dispute as they had listed the correct size.

No Laurie, EU sizes have smaller gaps between than UK sizes, so a 7 could be a 40 or 41 - there's a lot of variation anyway. Not to mention differences between men's and women's fittings (as someone who thought size 7 DMs fit, won some size 7 DMs, but they were womens not mens fit and thus too small...)
