grr, I do hate sellers sometimes

I bought a brand new bag and when I got it there was a tobacco smelling, tea stained looking tissue and a packet of matches in one of the pockets. The seller apologised and said her friend has used it but it's in as new condition (Hmm, yeah great, I got the bag as a gift). I replied that I wanted a refund but seller is refusing as she doesn't do refunds, the bag cost more than £50 and it's as good as new (except it isn't though is it?). I also don't give a rats ar$$e if it cost her £500!

I also noticed that I had been overcharged on the postage and had in fact paid for 1st class recorded and the bag was sent 2nd class packet rate. I have now opened a dispute.

It was only £3 for the bag and £4.50 postage. I was thinking it wasn't worth it but if everybody thought that, these people will get away with it! I haven't escalated it to a claim yet though. Was hoping it might make her see that I mean business and that she'll offer me a refund.

If you paid by paypal you can claim your money back. A seller can't state an item is new if it's not. If she's told you it's been used, she's mis-sold it. You have every right to claim your money back.

If the dispute doesn't get resolved as you'd like via Ebay, process a chargeback request via paypal...

Don't let it put you off too much. Not all sellers are the same. I'd die before I sold something as new that wasn't.

If it's out of the wrapper, that's the first thing I put....I'd hate anyone to buy something from me that they weren't 100% happy with! And there are a lot of sellers like that around, so I hope you sort it soon and that it doesn't put you off.

Well, i've had an e-mail this morning from her saying that I can have a refund and she will refund me when she has the bag, but I don't see why I should be out of pocket and have to pay the return postage (which I will have to send recorded now). I've sold a couple of things that buyers weren't heppy with and either refunded them first with the return postage included, or sent them a pre-paid envelope!

You are a better seller than some Bex! By ebay rules, I don't think she has to refund postage. Unfair imo but there you go. Considering how much it cost you and how much postage would be it's probably just not worth it. At least you rattled her cage!

I'd ask her again for the postage refund. ask nicely pointing out that she said she would refund this. Give her time to do so and then, if she refuses or ignores then yes, I think due to this and and her unfriendly communication, a neut would be appropriate.

Bex, since the item did not fit description (listed as new when it was used and she admitted to you it was used), you should ask for a refund of postage emphasising the mis-description. Plus she wrongly described the method of postage.

She does not have to refund (price or postage) until she receives the bag from you. But she has refunded the price in advance, which is good.

If she agrees to refund the postage on receipt of the bag, I would be tempted to do so and hope she makes good on her word.

If not, I would leave her a negative. Bear in mind that since May this year, she is no longer able to leave you, as buyer, negative feedback for all the trouble she caused you.

nervousal - What I was expecting, whether for £3 or £30, was a brand new and unused bag! It wasn't, so why on earth would I want to keep it when it was bought as a gift anyway?

She refunded me when she reeceived the bag, but hasn't refunded me the return postage as promised. I'm waiting to hear from her.

nervousal, I personally think Bex is performing a public service by going out of her way to get a refund.

So many crap sellers rely on inertia to get away with things because they think people cannot be bothered to dispute a small value item and expect the buyers to write it off instead.

This seller should be pulled up good and proper. What business does the seller have to go around misrepresenting something as new when it clearly isn't? Something might start at £0.99 or £3 and end up £30 or £300 if you are mis-describing a sow's ear as a silk purse.

In fact, to be absolutely correct, Bex's feedback should reflect that there was a dispute as to the 'new' description resulting in a refund.

It is unfair that sellers can't leave a neutral/negative now, but I have a feeling that this seller would leave me a retaliatory neutral or negative, which is why ebay have put this new system in place.

I think i've been working in customer service for too long, lol. If it had said it had been used in the description, I wouldn't have bidded in the first place. i don't want the same thing happening to anyone else.

DP took a tin opener back to Morrisons yesterday as we couldn't get one of those Fray Bentos type pies open! We ended up wasting a pie which I was quite prepared to march into Morrisons with demanding another one, lol.

Good for you Bex, its too easy to not complain and let these bad sellers get away with it.

What happens if you get a bad buyer but the seller can't leave negative feedback? I can see why the new rule has been put in place but just wondering what happens if the buyer genuinly does deserve nagative feedback?

I am a seller too, and I too felt that the rule change (that sellers cannot leave bad feedback for buyers) is unfair.

Having griped about it on another board, the response I got was that if I was a good seller, I should not see any difference as most buyers are trustworthy and it makes no difference to their behaviour whether or not they can be blackmarked or not. Which is true - as a reliable buyer, I behave in exactly the same way as before the rule change.

Along with the rule change, I believe eBay has also tightened the rules on rogue buyers: a buyer who has more than 3 unpaid buyer strikes gets de-registered by eBay and the change also makes it easier for sellers to block unreliable sellers. I don't have the details but can look for them if people are interested.

as selers we would normally refund the price and potage on receipt (we used to do before to cover p&p but then too many items never came back...)

should point out lol that we sometimes offer no quibble refunds on our new goods, we're not crap or anything! just lots of people buy our stuff thinkings its compatible with their kit when its not.

i meant to say you can only leave positive for the bad buyer, or none at all. it really doesn't make sense.

our buyer gave us a neg for not offering an immediate refund (we were out for the day ). we refunded him the complete cost plus postage back to the uk but still stuck with the neg even though he has added a 'positive' comment.

We have ben bitten by new riles, though ebay did step in- somepne tried to blackmail us for extra gods or have neg feedback. we did get neg feedback (but 2 / 800 not so bad!) but her claim to get refund was thrown out

we did all this before the item was sent back. he made out it had stains and was the wrong size. received it back this morning all of it totally untrue, tempted to send a positive but with lots of facts about the buyer.
