... 11 days since I won an auction.

Seller contacts me 2 days later to say she's broke her leg and will post it in the next few days.

I contact her yesterday (10 days after winning and paying for item) asking when she'll be posting.

Heard nothing, received nothing.

Could I possibly tell her I've changed my mind and no longer want the item?
Would I be able to get a refund?

Any responses much appreciated.

Is this "Item not received" claim with ebay and paypal pretty straight forward, then?

You can always ask if she's willing to cancel the whole thing.

I don't think it's reasonable to expect everyone to answer their emails within 24 hours - she may be trying to post it today, and planning to contact you once that happens?

I'd give her some credit for letting you know fairly quickly that things had gone wrong on her end, initially, iyswim.

So, seller finally sends item after I open a dispute for "non receipt".

The thing she has sent me isn't the brand stated in listing.

Wy, oh why can't people just be straight forward?!

What the heck am I to do now?

I've mailed her asking for a refund if I return and am still waiting for her respose.

I still have non-receipt case open!

close the item not recieved dispute and notify ebay, then go here and open an item significantly not as described dispute, you could do the same in paypal
