Paid on 19 Feb - Royal Mail lost item - seller not refunding!!

Help. Am so upset now - we ordered a toy from an ebay seller to give as a gift at Easter time. We paid on 19 Feb via Paypal, and we were away for a few days in early March. When we got back we had a notice from ROyal Mail that we missed a delivery. The notice form was frustratingly blank though - no sender info, no reference number - anyway I took it to our sorting office pronto along with another notice we received. The sorting office had only one package for us. They claimed the second notice was irrelevant.
Well we never got our item from Ebay, the post office doesn't have it, and the seller has our money.
What can I do?????

open a dispute for item not received.
You have asked the seller if she has sent it etc haven't you?

oh thanks for the reply 6lost - but open a dispute how exactly? I tried on Paypal but it's past their 45 day requirement.

And yes I've exchanged many many emails with the seller - who unhelpfully just muses how she doesn't understand why the Royal Mail lost the item. Not my problem I say - give me the money back!

Lost items are usually NOT the seller's fault

I've always just accepted that if I don't pay Recorded Delivery then I have to take the chance that some stuff will be lost - and it has happened a few times

i have to agree its not sellers fault that item has been lost

i understand your upset and blame her as she has your money but she sent item and has not deliberatly stolen your money

i would ask her nicely and not act as if it is her fault and see if together you can come up with a way of resolving it

some sellers take no responsibility for items lost in post or damaged so check her listing and make sure it does not state this

it doesn't matter if they say they take no responsibility for items lost in post or damaged - if you paid by paypal you get your money back

I guess it's just the fact that she has my money and has offered to return none of it!

i've checked on Paypal already and it's past 45 days so apparently i can't get a refund there -- i thought i was better protected with Paypal...but apparently if you take time to resolve an issue, and go past 45 days, all your efforts are for nought!

the Blonde is right - it doesn't what they say on the listing - it is the seller's responsibility to get an item delivered, not just posted. Recorded delivery etc is for the seller's protection not the buyer's.
She should refund and then claim herself from the Royal mail.
It's a shame it's past the time frame, but i'd still ask her for a refund (hopefully she won't realise it's past the time, but i doubt it)
keep asking- remind her that it is her responsibility
