Paid by cheque and item not received-what do I do now?

Item I bought states it will be next day delivery.

As I paid by cheque I assumed seller would wait for cheque to clear first. Cheque cleared through my bank last Wednesday and I contacted seller to ask when I was likely to receive my item.

Seller emails back to saying "cheque not received". Of course I email back to say cheque is cashed. He replies apologising with some feeble excuse and item will be posted on Friday.

Assuming he was using the "next day delivery" service and I have still not received anything, is it too early to start a dispute?

Also what come back is there, when I paid by cheque and not paypal?

Don't think there is any come back at all in paying by cheque (may be wrong).

Is it really harsh of me to say to take it as a lesson learned and only use paypal / cash on collection for ebay in the future.

Really hope there is some comeback for you and you get your item / money back though.

I know you can call the police if you have the emails and proof of the cheque being cashed.
Internet crime is huge and I think DP had to get involved with something like this once.
He got his money back.

no protection for cheques I'm afraid - and it does sound like he knows this judging by his first response (just stalling you)

He sells loads of the same things. Others seem to have got theirs, some for auctions after mine. I seem to be unlucky because I paid by cheque as I don't have paypal.

Here's hoping it still comes.

Have left neutral feedback on the strength of saying he hadn't got the cheque when it had already been cashed. He will probably either do the same or neg me, but I don't really care, as I am fed up of Ebay.

Ooh thanks VS. Sad I know, but I have never had a message deleted on a thread I started before, I was delirious with excitement.
