How do ebay decide who is in the right?

Do you end up having to pay return postage?

The thing is the description of items can be so subjective. "Lovely condition" "Barely used" "As new" etc can vary so much from person to person and in particular from seller's opinion to buyers.
What was it?? How was it described?? How much did you pay?? How did it differ from the description?? Any obvious faults should be pointed out and if possible photographed. How would you like this resolved?? Would you be happy with a part refund?? Have you contacted the seller yet?
